In the Malaysian context, significant reference to the repealed Road Traffic Ordinance 1958 is made in view of the volume of decided cases when that legislation was in force. In many instances, the retention of the very words employed in the Road Traffic Ordinance which recur in the Road Transport Act render cases decided under the Ordinance pertinent.

The latest development in England includes legislation & cases have been incorporated in the text. Included in the observations in the relevant chapters are the Criminal Justice Act 2003, the Traffic Management Act 2004, the Railways and Transport Safety Act 2003, which came into force in 2004. The latest decisions both from Malaysia and in particular from England augment the text, and in relation to sentencing guidelines, specifically to dangerous driving are also included, the most significant being the decision of the English Court of Appeal in R v Cooksley.

The publication is the first local text on Road Traffic Offences, therefore including in a single volume, all Malaysian legislation and reported decisions on the subject. As far as primary legislation is concerned, the Road Transport Act 1987 as well as the Commercial Vehicles Licensing Act 1987 take centre stage, while are all other relevant legislation such as the Criminal Procedure Code and the Evidence Act 1950 are considered.

The Chapter on Driving Offences includes the offences of causing death by reckless or dangerous driving, reckless and dangerous driving, careless and inconsiderate driving and speeding under the Road Transport Act 1987. The offence of contravening Section 90(1) of the Road Transport Act 1987, or ‘insurance offences’ are covered in several chapters, namely, driving license, driving offences and commercial vehicles.

Samples of police summonses, namely the Polis 170A and the Polis 257 are also included. In Appendix H the latest road accident statistics are provided.
