The Public Authorities Protection Act 1948 (Revised 1978) (Act 198) remains an important piece of legislation in view of the fact that any action or proceeding against the Federal Government, State Governments and all those entities which may be defined to be ‘Public Authorities’ will fall within the purview of the Act. The Public Authorities Protection Act 1948 was amended with effect from June 1974 by section 2 of the Public Authorities Protection (Amendment) Act, 1974 (Act A252).

It has been stated that it is the Legislature’s intention to limit and minimise claims against public authorities and to ensure the genuineness of said claims by enacting Section 2(a) of the Public Authorities Protection Act 1948: Vasanthi Perumal & Anor v Tan Sri Ghani Patail & Ors [2009] 7 MLJ 391. The Public Authorities Protection Act 1948 was designed to govern the rights of persons desirous of asserting claims against public bodies or persons performing public duties, and it controlled also the rights of the public bodies or persons to the limited protection which it conferred upon them.

To augment the value of this publication as a research tool, an introductory chapter is included which inter alia, begins with the Object and Nature of Public Authorities Protection Legislation and as the Malaysian legislation is based on the law in the United Kingdom, also provides succinct information pertaining to the interpretation of the English legislation by the English Courts.
