The Banking & Financial Institutions Act 1989 (Act 372) (BAFIA) received the Royal Assent on August 23, 1989 and was published in the Gazette the following day. October 1, 1989 was the ‘effective date’ on which all the provisions of the Act came into force, except that January 1, 1990 was the effective date for the ‘scheduled institutions’. With the coming into force of the Banking and Financial Institutions Act 1989 (Act 372), the Finance Companies Act 1969 and the Banking Act 1973 were repealed, subject to the provisions of Section 128 of the Act. The Banking and Financial Institutions Act 1989 has classified financial institutions into three distinct categories that are:

  • Licensed Institutions
  • Scheduled Institutions
  • Non-Scheduled Institutions
